Section 7.07.032. Public notice of decision on request for determination of whether a certificate of need is required.

The department will publish notice of its determination under 7 AAC 07.031 in at least one newspaper of general circulation in the state and on the Alaska Online Public Notice System established under AS 44.62.175. In the notice, the department will (1) describe the proposed activity, including the name of the person who submitted the request, and the proposed service area; if the department has determined that a certificate of need is not required, the department will also include the estimated cost of the activity; and (2) state whether the department has determined that the proposed activity (A) cannot proceed unless a certificate of need is issued for the activity under AS 18.07 and this chapter, and that the department will begin its review of the application for a certificate of need after the application is received; or (B) does not require a certificate of need.
