Section 7.07.033. Request for reconsideration.

(a) A person who requested a determination under 7 AAC 07.031 may seek reconsideration of the determination by submitting a written request for reconsideration to the department. A request for reconsideration must (1) be postmarked no later than 30 days after the date of the written notice of determination issued under 7 AAC 07.031; (2) be signed by the person seeking reconsideration, or an authorized representative; (3) contain a description of the determination for which reconsideration is sought; and (4) identify, with supporting information, each reason for disagreeing with the department's determination. (b) The commissioner will issue a written decision on a request for reconsideration no later than 30 days after the date the department receives the request. The commissioner will base a decision on a request for reconsideration upon (1) the information provided in the request for reconsideration; (2) the records of the department; and (3) other available and relevant information. (c) If the commissioner changes the department's original determination, the department will issue a revised written determination. (d) A decision under this section constitutes the final administrative decision of the department.
