Section 7.100.562. Dependent family member allowance.

(a) The dependent family member allowance is the amount of the recipient's income that, when combined with the dependent family member's own income, will bring the dependent family member's total gross income as close as possible to the maximum dependent family member allowance authorized under 42 U.S.C. 1396r-5(d)(1)(C) without exceeding that allowance. If the dependent family member is living with an individual other than the community spouse, the dependent family member allowance is determined by deducting the dependent family member's income from the Family Medicaid qualifying income standards under 7 AAC 100.190(a)(2). (b) The dependent family member allowance may be increased by a decision under 7 AAC 49 or court order that a greater monthly amount is needed based on extreme financial duress of the dependent family member. (c) In this section "dependent family member" means a dependent child, as defined in 7 AAC 100.579, dependent parent, or dependent sibling of the long-term care recipient.
