Section 7.33.005. State approval required for methadone programs.

  • 	(a)  No methadone program may operate in Alaska without the prior approval of the department. A program may obtain approval from the department if a program is determined by the department to have submitted a satisfactory protocol (as defined in 7 AAC 33.165 and to be able to conform to all statutory requirements and regulations of the department.  
    	(b)  Approval of methadone maintenance and detoxification treatment programs is for a period of two years. The department will renew approval if a program seeking renewal is in compliance with applicable department regulations and demonstrates that it is providing effective treatment. The department will inspect an agency subject to this chapter before an approval expires to determine if the agency's program and facility meet the requirements of this chapter.  
    	(c)  The department may revoke its approval of a program that fails to comply with any applicable statutory or regulatory requirement. If the department determines that a program is not in compliance with a requirement, it will notify the program of that determination, specify which statute or regulation sets out the requirement, and advise the program that it must comply with the requirement within 30 days after receiving the notice. If the program fails to comply with the requirement within the time allowed and approval is revoked, an additional 10 days to close out administration will be granted.
