(a) An administrative review by the department under this section will be conducted by a person who was not involved in the decision being reviewed, and who is not subordinate to the person who made the decision. The department will issue a decision to grant or deny the relief sought and will provide the aggrieved facility with a copy of the decision within 15 days after receipt of the request under 7 AAC 39.800. The department will base its decision upon (1) the information provided in the request for administrative review; (2) the department's research, findings, and records; and (3) other available information that is relevant to the matter being reviewed. (b) The department will advise the facility of its right to appeal the decision to the division director under (c) of this section. (c) Within 15 days after receiving a decision on administrative review under (a) of this section, an aggrieved facility may submit a written appeal from that decision to the director of the division responsible for administering the child care grant program within the department. Within 30 days after receipt of an appeal, the director will review the department's records, the decision, and applicable law, and will issue a written decision on the appeal to the aggrieved facility. A decision under this subsection constitutes the final department decision.
