(a) A provider licensed under 7 AAC 57 shall meet the requirements of 7 AAC 10.1090. A provider described in 7 AAC 41.200(a)(2), (3), or (4) must meet the applicable requirements of the accrediting, certifying, or approving agency with respect to the presence of animals in the facility. (b) A provider described in 7 AAC 41.200(d) or (e) shall (1) ensure that any animal kept in the facility has no communicable disease, has all immunizations required under state and federal law, and is free of internal and external parasites; if immunizations are required, the provider must show proof of compliance to the department or a designee upon request; (2) inform parents of children in care of any animal present in the facility; (3) disclose to the department information regarding any animal in the facility, if that animal has (A) been the subject of a past contact with an animal control official because of aggressive behavior or biting; or (B) a history of aggressive behavior or biting, regardless of whether the animal has been the subject of a past contact with an animal control official; (4) notify the department within 24 hours of any occurrence of aggressive behavior or biting by an animal in the facility, including whether the occurrence resulted in a contact with an animal control official; (5) immediately remove from contact with children in care, an animal described in (3) or (4) of this subsection; and (6) permanently remove from the facility an animal described in (3) or (4) of this subsection, if the department determines that the animal is a threat to the life or safety of children in care.
