Section 7.53.200. Purpose and applicability of federal and state subsidies.

(a) The purpose of subsidized adoption and guardianship is to facilitate the placement of a child who is (1) determined under 7 AAC 53.205 to be a child with special needs who is hard to place; and (2) eligible for a subsidy under 7 AAC 53.222, 7 AAC 53.223, 7 AAC 53.225, or 7 AAC 53.226. (b) The purpose of a monetary subsidy described in (c) of this section is accomplished by providing a negotiated amount of financial assistance to an adoptive parent or guardian to help meet the child's special needs, if the adoptive parent or guardian is unable to meet those needs without financial assistance. (c) A subsidy under 7 AAC 53.200 - 7 AAC 53.299 consists of (1) a monetary adoption subsidy or a relative guardianship subsidy, with Medicaid coverage, under Title IV-E; (2) a monetary state adoption subsidy, with Medicaid coverage; (3) a monetary state adoption subsidy, without Medicaid coverage; (4) a monetary state guardianship subsidy, without Medicaid coverage; (5) a nonmonetary Title IV-E adoption deferred subsidy that provides Medicaid coverage only, with the option to renegotiate for a monetary subsidy, based on demonstrated changes in the child's special needs; (6) a nonmonetary state adoption deferred subsidy that provides Medicaid coverage only, with the option to renegotiate for a monetary subsidy, based on demonstrated changes in the child's special needs; or (7) a nonmonetary state adoption deferred subsidy without Medicaid coverage. (d) The department will not approve an agreement under this chapter for Title IV-E monetary assistance unless, in addition to the applicable requirements of this chapter, the applicable requirements of Title IV-E, adopted by reference in 7 AAC 53.299, are met.
