In the public interest, the department will, in its discretion, waive the fee established under 7 AAC 80.010 - 7 AAC 80.090 for a public health service if the department determines that (1) a public health emergency exists and health services at no cost to the public are needed to meet the emergency; (2) provision of the health services is necessary for the prevention or treatment of a communicable disease, and charging a fee would seriously deter receipt of the health services and cause risk to the general public; (3) the public health is otherwise best served by the waiver of the fee; or (4) the health service is being provided to an individual under one of the following circumstances: (A) the individual's initial contact with the department is in response to a request or requirement of a person other than the individual, or other than the individual's parent or parents if the individual is a minor who lives with the parent or parents; or (B) the department initiated the contact with the individual for the purposes of communicable disease control.
