(a) At the commencement of an inspection the employer must identify areas of work that contain or that might reveal a trade secret. If the department's representative has no reason to question that identification, information obtained in those areas, including all negatives and prints of photographs, digital images, and environmental samples, will be labeled "Confidential Trade Secret" and will not be disclosed except in accordance with AS 18.60.099. (b) Upon the request of an employer, the employees' representative authorized by 8 AAC 61.050, in an area containing trade secrets, will be an employee in that area or an employee authorized by the employer to enter that area. Where there is no representative of employees, the department representative will consult with a reasonable number of employees who work in that area concerning matters of safety and health.
