(a) After considering the record and the hearing officer's proposed decision and order, the agency panel assigned to hear the case will prepare a final written decision and order. (b) Relevant decisions of the National Labor Relations Board and federal courts will be given great weight in the decisions and orders made under this chapter and AS 23.40.070 - 23.40.260 and AS 42.40.720 - 42.40.890. (c) If a quorum of an agency panel assigned to hear a case is deadlocked and cannot reach a decision and an agency member who is qualified to serve as a third member under AS 23.05.360(f) is available, the chair will assign the member to consider the case on a review of the record and to break the deadlock. If an agency member qualified under AS 23.05.360(f) is not available, the chair will refer the case to the full agency to consider the case on a review of the record and to issue a decision and order under (a) and (b) of this section.
