(a) A licensee, or his designee, must request an evidentiary hearing within 15 working days after any administrative review decision he or she wishes to appeal. (b) The following procedures apply to the conduct of an evidentiary hearing: (1) If a licensee is denied a right or privilege, the division will issue a statement of issues setting out the reasons for the denial. (2) If a licensee's license is revoked or suspended, or the licensee is otherwise disciplined, the division will issue an accusation setting out the reasons for the action. (c) The Administrative Procedure Act (AS 44.62.330 - AS 44.62.640) applies to the evidentiary hearing. (d) Nothing in this section precludes a qualified person from filing a request to arbitrate a grievance under 20 U.S.C. 107d-1.
