Section 9.23.040. Communication with attorney general during negotiation process.

  • 	(a)  After the attorney general approves the negotiation request under AS 23.50.020(d) and 9 AAC 23.020, the authorized third party shall provide to the attorney general the information required in AS 23.50.020(d)(4), and a copy of all written communications that pertain to the negotiations, including communications between the  
    		(1) authorized third party and the health benefit plan;  
    		(2) authorized third party and the participating physicians; and  
    		(3) health benefit plan and the participating physicians.  
    	(b)  The authorized third party shall provide a brief summary of the status of negotiations to the attorney general every 30 days until a proposed contract is reached or the negotiations are otherwise terminated. The status summary must include a description of the areas or terms agreed upon, the areas or terms of continuing disagreement, and any modification of the scope of the subject matter under discussion.  
    	(c)  The authorized third party shall notify the attorney general if negotiations have been declined by the health benefit plan, or if the health benefit plan has refused to respond to a request to negotiate. Notice must be given promptly, but no later than 14 days after the authorized third party has sufficient information to confirm the health benefit plan's declination or refusal.
