Section 17.42.400. Public notice.

  • 	(a)  Except as provided in (b) or (d) of this section for a permit with a term of 120 days or less, when this chapter requires public notice the airport manager shall give the public at least 30 days notice by  
    		(1) publishing the notice once in the Alaska Online Public Notice System; and  
    		(2) posting the notice for at least three consecutive weeks in at least one public place on or near the airport.  
    	(b)  When the airport manager gives notice of a permit under this chapter for use of airport property with a term of 120 days or less, the manager shall post the notice for seven days in a public place on or near the airport.  
    	(c)  The applicable notice period required under this section begins on the first day that the notice is either published or posted, whichever occurs earlier.  
    	(d)  Public notice under this section is not required if the application for the lease, permit, concession, material amendment, or other interest is  
    		(1) from a state agency for a use that the airport manager finds to be in the best interest of the airport;  
    		(2) for a business activity permit under 17 AAC 42.105, a commercial passenger vehicle permit under 17 AAC 42.095, a vehicle rental business permit under 17 AAC 42.100, an aircraft tiedown permit under 17 AAC 42.500 - 17 AAC 42.599 or 17 AAC 42.600 - 17 AAC 42.699, or a transient aircraft parking permit under 17 AAC 42.035;  
    		(3) for a right of way for a road or utility, including FAA utilities, that will serve the airport or airport tenants;  
    		(4) for an agreement entered into under 17 AAC 42.040 and the applicant does not request a lease of department-operated terminal space; or  
    		(5) for a permit for use of airport property for 30 days or less.
