Section 18.69.080. Discharges from small commercial passenger vessels; logbook.

  • 	(a)  In determining compliance with AS 46.03.463(f), the department will consider the owner or operator of a small commercial passenger vessel to have a properly maintained and properly operated marine sanitation device if  
    		(1) the vessel has a manufacturer's certification plate specifying the type of marine sanitation device;  
    		(2) the marine sanitation device is in good working order;  
    		(3) while the marine sanitation device is used in the marine waters of the state, the owner or operator operates the marine sanitation device according to the operating specifications of  
    			(A) the manufacturer;  
    			(B) a registered engineer; or  
    			(C) a classification society; and  
    		(4) the owner or operator maintains the marine sanitation device according to the maintenance specifications of  
    			(A) the manufacturer;  
    			(B) a registered engineer; or  
    			(C) a classification society.  
    	(b)  An owner or operator of a small commercial passenger vessel shall maintain on board for three years a marine sanitation device maintenance and operations logbook that documents all maintenance performed for each marine sanitation device used on a small commercial passenger vessel that operates in the marine waters of the state.
