(a) In addition to complying with the requirements of 40 C.F.R. 141.73 (filtration), adopted by reference in 18 AAC 80.010(a), the owner of a community water system, non-transient non-community water system, or transient non-community water system that uses conventional filtration, direct filtration, or slow sand filtration may submit a written request to the department to allow a higher turbidity level. On a case-by-case basis and if the written request includes sufficient information to allow a determination in accordance with standard sanitary engineering practices and principles, the department will determine whether to allow turbidity levels of up to (1) one NTU for a system using conventional filtration or direct filtration under 40 C.F.R. 141.73(a), adopted by reference in 18 AAC 80.010(a); (2) five NTUs for a system using slow sand filtration under 40 C.F.R. 141.73(b), adopted by reference in 18 AAC 80.010(a). (b) A community water system, non-transient non-community water system, or transient non-community water system that meets the requirements in 40 C.F.R. 141.73(d), adopted by reference under 18 AAC 80.010(a), to use an alternative filtration system, and that serves fewer than 10,000 individuals, must comply with the requirements of 40 C.F.R. 141.550 - 41.553 (combined filter effluent requirements), adopted by reference in 18 AAC 80.010(a).
