(a) With the prior approval of the director, an appointing authority may appoint a nonpermanent employee to perform the work of a permanent employee when the permanent employee is on leave. Appointment is limited to the duration of the incumbent's leave. Nonpermanent employees appointed under the provisions of this subsection do not have the rights of employees who hold permanent substitute appointments. (b) An appointing authority may appoint a substitute permanent employee to perform the work of another permanent employee when the employee of record is on approved leave for a period expected to exceed the probationary period. The substitute employee appointed under the provisions of this section is entitled to all rights of a permanent employee except that the substitute employee will be laid off upon the return of the incumbent of record unless the substitute employee is on leave from another position under 2 AAC 07.500(4). In that case, the substitute employee shall return to the employee's own position with no right of layoff.
