Section 2.35.222. Certain periods to count toward vesting in the defined contribution plan and the health reimbursement arrangement plan.

(a) A period during which a member of the defined contribution plan (AS 39.35.700 - 39.35.990) is receiving an occupational disability benefit under AS 39.35.890 constitutes membership service for the purposes of determining vesting in employer contributions under AS 39.35.790(b) and eligibility for retirement and medical benefits under AS 39.35.700 - 39.35.990 and under the health reimbursement arrangement plan (AS 39.30.300 - 39.30.495). (b) If a member of the defined contribution plan receiving or entitled to receive an occupational disability benefit under AS 39.35.890 dies while receiving that benefit or before the commencement of the benefit, the period during which the member was eligible for the benefit and the period during which a survivor's benefit was paid to a survivor of the member constitute membership service for the purposes of determining vesting in employer contributions under AS 39.35.790(b) and eligibility for retirement and medical benefits under AS 39.30.300 - 39.30.495 and AS 39.35.700 - 39.35.990. (c) If a member of the defined contribution plan suffers an occupational death under AS 39.35.892, the period during which a survivor's benefit is paid to a survivor of the member constitutes membership service for the purposes of determining vesting in employer contributions under AS 39.35.790(b) and eligibility for retirement and medical benefits under AS 39.30.300 - 39.30.495 and AS 39.35.700 - 39.35.990.
