Section 20.05.673. Economic dependence point system for the Prince William Sound roe herring gillnet fishery.

  • 	(a)  The commission will award a maximum of 7 points to an applicant for economic dependence on the Prince William Sound roe herring gillnet fishery in accordance with the following:  
    		(1) the commission will award a maximum of 3 points to an applicant for ownership of a vessel used, or to be used, in the commercial gillnet harvest of roe herring as follows:  
    			(A) 1 point if the applicant owned the vessel on March 1, 1978;  
    			(B) 1 point if the applicant owned the vessel on March 1, 1977; and  
    			(C) 1 point if the applicant owned the vessel on March 1, 1974;  
    		(2) the commission will award a maximum of 3 points to an applicant for ownership of gear used, or to be used, in the commercial gillnet harvest of roe herring as follows (available in addition to points claimed in (1) of this subsection):  
    			(A) 1 point if the applicant owned the gear on March 1, 1978;  
    			(B) 1 point if the applicant owned the gear on March 1, 1977; and  
    			(C) 1 point if the applicant owned the gear on March 1, 1974;  
    		(3) availability of alternative occupations in the location of the applicant's domicile as of the qualification date. (Maximum of 1 point possible.)  
    			(A) An applicant is entitled to 1 point if his or her domicile is located more than 30 road miles from  
    				(i) the boundary of a "place" with a population of 20,000 or more as of April 1, 1970, and  
    				(ii) an "urbanized area" as of April 1, 1970.  
    			(B) An applicant is entitled to 0 points if his or her domicile is located within 30 road miles of the boundary of a "place" with a population of 20,000 or more, or within 30 road miles of an "urbanized area" as of April 1, 1970.  
    			(C) An applicant from a 0 point area may receive the maximum of one point through a special showing that there is no reasonable daily access from the applicant's domicile to the "places" and "urbanized areas" referred to in (B) of this paragraph.  
    			(D) "Place" means an area recognized as a place in Appendix A of the United States Department of Commerce 1970 Census of Population, Volume 1, "Characteristics of the Population", Chapter B, "General Population Characteristics", Part 3, which is incorporated into this section by reference.  
    			(E) "Urbanized area" means a city of 50,000 or more and its surrounding urban areas; it is defined specifically in Appendix A of the United States Department of Commerce 1970 Census of Population, Volume 1, "Characteristics of the Population", Chapter B, "General Population Characteristics", Part 3, which is incorporated into this section by reference.  
    	(b)  If a vessel or gear is owned jointly or in a corporate capacity, the commission will award points under (a)(1) and (a)(2) of this section on the basis of the comparative ownership interests of each applicant who is eligible to apply and does apply for a Prince William Sound roe herring gillnet permit.
