(a) The ombudsman shall maintain a confidential record received from an agency subject to the same restrictions on disclosure that apply while the record is in the custody of the agency. (b) If another agency would have access to a confidential record during the normal course of business, then the ombudsman may disclose the record to that agency to the same extent that it could be disclosed by originating agency. (c) If the agency providing a confidential record informs the ombudsman that access to the record is restricted to specific employees within the agency, the ombudsman may request a written explanation of the limits on disclosure and the applicable law.
