(a) If an agency provides the ombudsman with attorney-client privileged communications or attorney work product, then the ombudsman shall label the records as "attorney-client privileged" or "attorney work product" and shall maintain the privileged material separately from other records received from the agency. (b) If the ombudsman includes privileged material in correspondence to an agency, including an investigative report to that agency, the ombudsman shall (1) label the correspondence as containing privileged material; and (2) provide the correspondence only to agency employees entitled to receive the privileged information.
