(a) When competitive sealed bidding is used, the procurement officer shall issue an invitation to bid. It must include a time, place, and date by which the bid must be received, a purchase description, a description of all contractual terms and conditions applicable to the procurement including the bid evaluation criteria, and the basis for award. (b) A bidder must have a valid Alaska business license before contract award. (c) A bidder for a construction contract must submit evidence of the bidder's registration under AS 08.18 at the time designated in the invitation to bid. (d) If the chief procurement officer makes a written finding that the release of the estimated cost of goods or services would adversely affect the authority's ability to obtain the best competitive bid, the estimated cost of the goods or services is confidential during the solicitation process and may not be released to the public before bid opening. (e) A bidder, in the submission of a bid, must certify under penalty of perjury that the price submitted was independently arrived at without collusion.
