Section 3.26.695. Relationship to federal privacy laws.

	(a)  If a licensee complies with all the requirements of 45 C.F.R. Parts 160 and 164 even though the licensee is not required to comply, the licensee is not required to comply with 3 AAC 26.680, 3 AAC 26.685, and 3 AAC 26.690 with respect to health information.  
	(b)  Nothing in 3 AAC 26.605 - 3 AAC 26.749 modifies, limits, or supersedes 15 U.S.C. 1681 - 1681x (Fair Credit Reporting Act) or creates an inference regarding whether information is transaction or experience information under 15 U.S.C. 1681 - 1681x.
