(a) When a requested increase is approved, the increase is retroactive to the effective date specified in the notice of increase. (b) Rent increases having an effective date within the 120 days before the declaration of a housing emergency, which are paid but which are later denied in whole or in part, shall not be refunded to the tenant. (c) Proposed rent increases having an effective date after the declaration of a housing emergency, which a tenant mistakenly pays and is subsequently denied in whole or in part, shall be refunded to the tenant.
