Section 7.100.504. Elective pre-application resource assessment.

  • Before submitting an application for Medicaid under 7 AAC 100.500(2) or at the beginning of a continuous period of institutionalization, a potential applicant, the potential applicant's spouse, or a representative acting on behalf of either, may, upon request, receive the department's pre-application assessment of the potential applicant's resources or the married couple's combined resources. Consistent with 7 AAC 100.502 and 7 AAC 100.506, the department will calculate the value of the individual's or married couple's countable resources as of the date on which the potential applicant entered or is likely to enter a medical institution. If a requester disagrees with the department's pre-application resource assessment, the requester may not appeal that decision, but may file an application to receive an eligibility determination. When the department receives a Medicaid application, the department will determine eligibility based on the information submitted with the application and verified after the application date. The department will not conduct the assessment under this section for an individual applying for home and community-based waiver services under 7 AAC 100.500(3).
