Section 7.12.321. Abuse, neglect, and mistreatment.

(a) A hospice agency shall (1) develop and implement written policies and procedures that prohibit abuse, neglect, and mistreatment of clients; (2) document alleged or suspected incidents of abuse, neglect, or mistreatment by an employee, volunteer, or contractor; (3) investigate alleged or suspected incidents of abuse, neglect, or mistreatment; (4) take any necessary action to remove the potential for further abuse, neglect, or mistreatment of a client or further misappropriation of a client's property; (5) document the result of the investigation and the corrective action taken within five days after the agency becomes aware of an incident described in (2) and (3) of this subsection; (6) submit the documentation prepared under (5) of this subsection to the department; and (7) assure that an employee, volunteer, or contractor does not obtain a client's power of attorney in violation of AS 13.26.358. (b) A hospice agency is subject to the reporting requirements of AS 47.17.020 and AS 47.24.010. (c) A hospice agency shall contact the appropriate licensing authority to verify the disciplinary history of a potential employee or contractor who is required to hold a license to practice.
