(a) For compensable injuries occurring on or after November 7, 2005, if the employee has been totally unable to return to the employee's employment at the time of injury for 45 consecutive days as a result of the injury, the employer shall notify the administrator in writing on the 46th day. The notification must be completed on a form prescribed by the administrator. No more than 14 days after the 45th day, the administrator shall notify the employee of the employee's rights to reemployment benefits. (b) If the employee has been totally unable to return to the employee's employment at the time of injury for 90 consecutive days, as a result of the injury, the employer shall notify the administrator, in writing, on the 91st day. The notification must be completed on a form prescribed by the administrator.
