(a) As provided in AS 18.63.050(2) and 18.63.070, the department will issue a citation, with a penalty, to a person who employs or contracts with a professional painter to perform hazardous painting if the professional painter does not have a certificate issued under 8 AAC 61.800 - 8 AAC 61.890. The department will also impose a civil penalty on a person who provides a falsified hazardous painting certificate to an employer or makes a false statement to an employer or the department regarding the person's certification. The department will consider the severity of the violation in determining the amount of a penalty under this subsection. (b) The department will issue a citation with penalty, as provided in AS 18.63.050(3) and 18.63.070, to a professional painter who uses a falsified hazardous painting certificate to obtain employment for which certification is required under AS 18.63 and 8 AAC 61.800 - 8 AAC 61.890. (c) For purposes of (a) of this section, a separate citation will be issued for each professional painter who is not certified as required by AS 18.63 and 8 AAC 61.800 - 8 AAC 61.890. Each citation will, in the department's discretion, include a separate penalty.
