(a) A contractor shall maintain a case file for each participant enrolled in the program, which includes (1) the participant's certification of eligibility; (2) referral to other agencies; (3) the participant's individual employment plan; (4) job training or placement provided; (5) workshops provided; (6) follow-up documentation. (b) The contents of a participant's file are confidential and may be released and disclosed only with the written consent of the participant, by court order, or at the request of a duly authorized government official. Information contained in a client's file may be released in a manner which does not identify individual participants. (c) A government official who requests confidential information must provide a copy of the statute, regulation, or policy controlling disclosure of confidential information for his or her respective agency.
