Section 6.40.060. Advancement of lower-preference applications.

  • An application in a preference category described in 6 AAC 40.050(a)(2) - (4) may be advanced ahead of higher-preference applications if, because of the magnitude of the problem addressed, the program is essential or beneficial to the maintenance of life, health, or safety. For example, an economic development program may be considered essential if a predominant industry or a business district has been destroyed, leaving residents economically unable to obtain food, water, shelter, heat, emergency medical services, or police and fire protection.
