Section 7.79.030. Temporary procedures.

  • 	(a)  The provisions of 7 AAC 78.040 - 7 AAC 78.090 and 7 AAC 78.110 do not apply to grants awarded under (b) of this section. For grants awarded under (b) of this section, the division will use the procedures established in this section.  
    	(b)  The division will  
    		(1) make initial awards of grants under this chapter by June 30, 1981;  
    		(2) make additional awards of grants under this chapter within 15 days after money becomes available to the division for that purpose for the fiscal year ending June 30, 1982; and  
    		(3) in its discretion, award additional grants under this chapter by June 30, 1982, if money is available to the division at that time for that purpose.  
    	(c)  Upon written request, the division will provide a prospective applicant described in 7 AAC 79.020 with an application form for a grant under (b) of this section. The division will provide public notice of the availability of the application forms and of the availability of money to make grants under (b) of this section.  
    	(d)  The division will consider an application for a grant under (b) of this section only if the  
    		(1) division receives the application by  
    			(A) April 10, 1981, if it is an application for a grant under (b)(1) or (2) of this section; or  
    			(B) April 9, 1982, if it is an application for a grant under (b)(3) of this section; and  
    		(2) application includes  
    			(A) the signature of an agent, officer, or employee who is authorized by the applicant to sign the application; and  
    			(B) the information requested in the application; and  
    			(C) a project budget which reflects the manner in which the applicant expects to use the grant.  
    	(e)  If the division determines that the requirements of (d)(1) and (d)(2) of this section are satisfied with respect to an application, the division will  
    		(1) by April 17, 1981, with respect to an application for a grant under (b)(1) or (b)(2) of this section, or by April 16, 1982, with respect to an application for a grant under (b)(3) of this section, send a copy of the application to the Governor's Advisory Committee on Aging, established in accordance with 45 C.F.R. 1321.47 (as adopted, March 31, 1980), for its review and written recommendation to approve or disapprove all or part of the application; and  
    		(2) by May 29, 1981, with respect to an application for a grant under (b)(1) or (b)(2) of this section, or by May 28, 1982, with respect to an application for a grant under (b)(3) of this section, review the application and make a written recommendation to approve or disapprove all or part of the application.  
    	(f)  By May 29, 1981, with respect to an application for a grant under (b)(1) or (b)(2) of this section, or by May 28, 1982, with respect to an application for a grant under (b)(3) of this section, the division will deliver to the commissioner a copy of the recommendations made under (e)(1) and (e)(2) of this section relating to the application. The commissioner will make the final decision to approve all or part of an application  
    		(1) no later than June 10, 1981, if the application is for a grant under (b)(1) of this section;  
    		(2) within 15 consecutive calendar days after money becomes available to the division to make the grants if the application is for a grant under (b)(2) of this section; and  
    		(3) no later than June 9, 1982, if the application is for a grant under (b)(3) of this section.  
    	(g)  In making the final decision to approve or disapprove all or part of an application under (f) of this section, the commissioner will consider  
    		(1) the recommendations made under (e)(1) and (e)(2) of this section; and  
    		(2) the criteria established in 7 AAC 78.100(1) - (2) and (4) - (16) and 7 AAC 79.050.  
    	(h)  The commissioner may approve an application under (f) of this section for a grant which differs in amount from the grant requested in the application.  
    	(i)  An application which the commissioner approves under (f) of this section is a contract between the department and the applicant. However, if the commissioner approves the application for a grant which differs in amount from the grant requested in the application, the contract is conditional upon  
    		(1) acceptance of the change in the grant amount by the applicant; and  
    		(2) negotiation of a revised project budget and, if appropriate, project description between the division and the applicant.  
    	(j)  After the commissioner makes a final decision to approve or disapprove all or part of an applicant's application, the division will send a written notice to the applicant before the appropriate date specified in 7 AAC 79.030(b).  
    	(k)  A grant awarded under (b)(1) of this section expires June 30, 1982.  
    	(l)  A grant awarded under (b)(2) of this section expires June 30, 1982. However, the division will, in its discretion, extend the expiration date if the division determines that there is good cause for the extension. The division will not extend the expiration date of a grant awarded under (b)(2) of this section beyond June 30, 1983.  
    	(m)  A grant awarded under (b)(3) of this section expires one year after the effective date of the grant. However, the division will, in its discretion, extend the expiration date if the division determines there is good cause for the extension. The division will not extend the expiration date of a grant awarded under (b)(3) of this section beyond June 30, 1983.
